Chicken Xpress Spin ‘N Win: Competition Rules

 

  1. Introduction

 

1.1    This Promotional Competition (“Competition”) is organised by Chicken Xpress Trading (Pty) Ltd and/or its designated agencies (collectively ‘’Promoters’’).

 

1.2    By entering this Competition, you confirm that you have read and understood these rules, and further that you agree to be legally bound hereby (“the Rules”).

 

  1. Duration

 

2.1    This Competition starts at 3pm on 8th November 2017 and ends at 12pm on 30th November 2017 (“the Duration”).

 

2.2    The Promoters, subject to theses Rules, reserve the right to extend the Competition Duration.

 

  1.     Participants – who may enter the competition

3.1    The promotional competition is open to permanent residents and citizens of South Africa over the age of 18 years in possession of a valid South African passport, except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoters and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoters, their advertising agencies, advisers, dealers, suppliers (“Disqualified Persons”). The Promoters reserve the right to request proof of identity to determine whether the participant is at least 18 years of age.

 

3.2    By entering the Competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary.

 

  1. Entry

4.1    Participants enter the competition by doing ALL of the following:

4.1.1 Liking the Chicken Xpress Facebook page (if Competition participant has not already done so);

4.1.2 Liking the Spin ‘N Win Facebook post on the Chicken Xpress Facebook page;

4.1.3 Sharing the Spin ‘N Win Facebook post on the participant’s own newsfeed.

4.1.4 Pausing the Spin ‘N Win Facebook post just in time for the arrow to match up exactly with one of the products. Once the participant has done that, they must take a screen shot of the arrow matching up exactly with the product and post it in the comments section of the Spin ‘N Win post.

4.2    Participants may enter the promotional competition as many times as they wish provided they follow the entry mechanics listed in 4.1 above.

 

  1. Prize

5.1    The prize consists of two of that product which the arrow lands on which applies to only one (1) store location of the winners choice.

 

  1. General

6.1    The Promoters reserve the right in their absolute discretion to disqualify any entrant if they have reasonable grounds to believe that an entrant has breached any of the Rules, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with the Rules could lead to the Promoters disqualifying that person, without the Promoters giving any reason for such disqualification or granting any opportunity for challenge.

6.2    Valid participants names will be placed in a box where the Chicken Xpress will draw a name out at random.

6.3    Winners will be notified via Facebook inbox message on 30th November, and a general post will be made on the Chicken Xpress Facebook page.

6.4    Entries which are unclear, illegible, submitted via an incorrect entry mechanism, contain errors or are from Disqualified Persons will be declared invalid.

6.5    Entries must not contain explicit language. The promoters reserve the right to remove any entries containing such language will be disqualified in the pre-screening process.

6.6    The Prizes are neither transferable nor redeemable for cash and the Promoters are not liable for any defect in the Prizes. The Promoters reserve the right to substitute Prizes with any other prize of comparable commercial value.

6.7    Should any dispute arise in relation to the interpretation of these Competition rules, the Promoters’ decision shall be final and no correspondence shall be entered into.

6.8    All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents and suppliers, their affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters) and/or use of the Prizes.

6.9    The Promoters may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prizes and it shall revert back to the Promoters.

6.10    The Promoters may require the winners to be identified, photographed and published in printed media, or to appear on radio and television, when accepting their Prizes and/or after having received their Prizes. The winners will be given the opportunity to decline the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.

6.13   Lee Swales, an admitted attorney, will independently oversee the competition and compliance with the Rules.

6.14    Any provision of these Rules or the Competition which is held to be invalid or unenforceable shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions thereof.

6.15    This Competition shall comply with, and will be subject to, any peremptory provisions of the Consumer Protection Act No. 68 of 2008 (“CPA”), which are deemed to be incorporated herein. In the event of any conflict between these rules and the CPA provisions, the latter shall prevail.
